Failure to Accommodate
Under the Americans with Disabilities Act (ADA) and the California Fair Employment & Housing Act (FEHA), you are legally protected if an injury, disability or illness prevents you from performing your normal duties. Failure to hire because of a disability is also illegal. Once hired, your employer must take reasonable measures relating to your limitations or medical condition to enable you to do your job.
Example scenarios:
- A construction worker becomes disabled and cannot perform the same work. The employer must find another job that person can do, or modify the existing job requirements.
- A pregnant woman who is ordered by her doctor to limit physical activity cannot be compelled to work the factory floor for eight hours a day. She must be allowed to perform light duty part of the day or work less hours with full pay.
- A clerical worker requests a new ergonomic chair after a back surgery, because the old one causes her severe pain. The employer must honor this request.
